They correspond to § 7 of the General Terms and Conditions and are made available separately as part of the invitation.
1.Who these terms apply to
You are using User Flow because a company — for example an agency or a Creator — has invited you to do so. That company is the Contracting Party of User Flow. It is referred to below as the "Contracting Party".
Registration without an invitation from a Contracting Party is not possible.
2.You do not enter into your own contract with User Flow
The user agreement for the Platform exists exclusively between User Flow and the Contracting Party.
By setting up your user account, you do not become a contracting party of User Flow. Nor do you thereby acquire any claim of your own to the Platform being provided.
Where the Contracting Party's contract ends, or where the Contracting Party withdraws your authorisation, your access to the Platform ends as well.
3.What you must observe
By using the Platform, you undertake
- to use the Platform exclusively within the scope of the permissions and instructions granted to you by the Contracting Party,
- to keep your access credentials confidential and not to disclose them to third parties,
- to use the Platform exclusively in accordance with applicable law and with the terms of use of the connected third-party platforms,
- to treat personal data to which you gain access via the Platform as confidential and to use it exclusively for the purposes specified by the Contracting Party,
- not to copy, store, pass on or publish content, data or information from the Platform without authorisation,
- to refrain from the acts listed under section 4,
- and to inform User Flow and the Contracting Party without undue delay if you become aware of a security incident or unauthorised access to your user account.
4.What is not permitted
The following are in particular prohibited:
- using the Platform for unlawful purposes,
- infringing the rights of third parties,
- circumventing or impairing technical protection measures or security mechanisms,
- providing or distributing malware or other harmful content,
- manipulating the Platform or impairing its functionality,
- carrying out automated access outside the functions provided for that purpose,
- using functions outside their intended purpose,
- disclosing access credentials without authorisation,
- using third-party user accounts or third-party platform accounts without authorisation,
- providing or distributing content that violates statutory provisions, in particular depictions involving minors or content distributed without the consent of the persons depicted,
- and carrying out any other acts capable of impairing User Flow, other users or third parties.
This list is not exhaustive.
5.Who is responsible for your data
The Contracting Party is generally the controller under data protection law for the processing of your personal data within the Platform. It decides which functions are used and which evaluations it carries out.
This applies in particular to evaluations of your activity — for example the recording of active usage times, the traceability of messages processed, or key figures calculated from these.
Please therefore address questions about this processing and requests to exercise your data subject rights to the Contracting Party in the first instance.
In addition, User Flow processes certain data as controller in its own right, in particular your access credentials as well as authentication and log data necessary for the secure operation of the Platform.
Details of the data processed can be found in the Privacy Policy. It is made available to you as part of the invitation.
6.What User Flow does not do
User Flow does not evaluate communication content to create its own personality, behavioural or marketing profiles, and does not use it to train AI models.
No recording takes place outside active use of the application. In particular, no keystrokes are logged, no screen recordings are made and no mouse movements are monitored. No background monitoring of your device takes place.
7.Suspension
User Flow may suspend your user account temporarily where this is necessary in order to eliminate security risks, comply with statutory obligations, prevent serious breaches of these terms or protect the rights of third parties.
Where the reason for the suspension ceases to apply, the suspension will be lifted.
Independently of this, the Contracting Party may adjust or withdraw your permissions at any time.
8.Application of the General Terms and Conditions
The General Terms and Conditions of User Flow apply additionally, insofar as they concern Invited Users.
In the event of contradictions between these Terms of Use and the General Terms and Conditions, these Terms of Use for Invited Users shall take precedence.
9.Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
